01 / INTELLECTUAL PROPERTY & COPYRIGHT

  • Ownership: All artworks, visual assets, photographic documentation, written copy, brand design elements, and sculptural concepts displayed on this platform remain the exclusive property of Naqaa Art, protected under national and international intellectual property laws.
  • Restrictions: Any unauthorized reproduction, duplication, modification, redistribution, or commercial exploitation of any material is strictly prohibited without prior explicit written authorization from the studio.

02 / CONDITIONS OF PORTAL ACCESS

Visitors agree to navigate this platform in compliance with applicable law and ethical standards. Any attempt to compromise the technical integrity, security framework, or reputation of Naqaa Art—or to use this portal for fraudulent or illicit purposes—is strictly prohibited.

03 / WORKS, EXHIBITS & VALUATION

  • Availability: Standard catalog pieces within THE VAULT are subject to finite stock availability. In the rare event an item becomes unavailable following order confirmation, the collector will be notified immediately to select an alternative work or receive a full reimbursement.
  • Valuation: All prices are displayed in Euros (€) and include applicable Value Added Tax (VAT). Shipping and specialized white-glove transport fees are calculated during checkout.
  • Material Variation: Because each work balances raw elements—including pure glass, crystalline structures, velvety gypsum, and organic matter—slight natural variations in texture, tone, and surface detail will occur between digital depictions and the physical artwork. These variations serve as the hallmark of true authenticity.

04 / BESPOKE & ARCHITECTURAL COMMISSIONS

  • Scope: Custom commissions and tailored architectural installations are finalized through private consultation and agreed specifications.
  • Execution: Production commences strictly upon confirmation of payment or the required deposit as outlined in the provided project proposal.
  • Revocation: In accordance with our Archival Returns Protocols, custom and made-to-order works cannot be canceled or returned once production has initiated, except in verified cases of transit damage or structural defects.

05 / PAYMENT & TRANSACTION CLEARANCE

All financial transactions are handled via encrypted, high-security third-party payment infrastructure. Naqaa Art never stores credit card or banking details. Work preparation and dispatch protocols commence only after full payment validation.

06 / DISPATCH & LOGISTICS

Estimated delivery timelines vary depending on whether the work is an active catalog piece or a bespoke commission. Naqaa Art is not liable for transit delays resulting from courier operations, international customs procedures, or events of force majeure.

07 / LIMITATION OF LIABILITY

While the studio maintains high standards for digital infrastructure, Naqaa Art assumes no liability for temporary platform outages, technical interruptions, or indirect damages arising from portal access or temporary unavailability.

08 / GOVERNING LAW & JURISDICTION

  • Applicable Law: These Terms of Service are governed exclusively by Portuguese Law. Any unresolved disputes arising from these terms shall be submitted to the competent court of Naqaa Art’s registered location.
  • Consumer Dispute Resolution: In the event of a consumer dispute within Portuguese territory, collectors may seek resolution through accredited Alternative Dispute Resolution entities (Entidades de Resolução Alternativa de Litígios de Consumo – RAL).

09 / DIRECTIVE AMENDMENTS

Naqaa Art reserves the right to revise or update these Terms of Service at any time. All updates become effective immediately upon publication to the portal.
